Data Protection Policy

1. Who is responsible for processing your data?

Identity: ASUNTOS GLOBALES DE COMERCIO, S.L.U. (Banak), company which manages the URL www.banak.ie, with VAT number B98056328 and with registered office in Gran Vía Fernando el Católico, 14-15, 46008, Valencia (Valencia).

2. For what purpose do we treat your data?

Banak will process your information for the purposes indicated below:

a) Responding your requests or queries made by you as a user of the Website.

b) Management of the orders and the acquired items (this means that we process the information internally for administrative, fiscal and accounting purposes).

c) Effective shipment and delivery of the items.

d) Application and management of the established legal guarantees.

e) Financing your purchase if you wish.

f) And maintenance of commercial, promotional and advertising communications, as long as you provide us your consent.

3. How long do we store your data?

a. Personal data provided will be generally stored for a minimum period of four years, especially if you have made a purchase.

b. In the event that you have not made any purchase, but you receive our newsletter or our commercial mailings, we will keep your personal data until you indicate your refusal to receive them. We have enabled a simple method that allows you to unsubscribe at any time, following the instructions provided.

c. Regarding CVs received through our email personas@banak.com, enabled for this purpose, they will be store for a maximum period of twelve months from their reception. After this period, if we have not received any update of the CV, we will proceed to its destruction.

d. Data related to financial operations and that prove them are stored during and after the payment of an order for a minimum of four years.

4. Why are we allowed to process your data?

First: because you allow us to treat your data for the purposes indicated when you give your consent, especially in the moment of the registration as a user of Banak, or when you indicate that you are interested in receiving information about us and our activities.

Below, you will find the description of the different sections in which we can ask for your personal data:

A. Registration on the Website.

By registering in the section Sign Up of our website, you can enjoy the services offered by Banak and manage your purchases directly through our portal. The storing of information about the registration will have as a purpose the maintenance of the business relationship with Banak, managing in its case the shipment of the order made.

On the other hand, if you finance a purchase of our items, your personal data will be transferred to the financing companies with which we cooperate in order to obtain the financing; you cannot process it if you don’t consent this transfer.

The purchaser’s bank data will never be stored by Banak.

B. Doubts about your order – Claims – Doubts about our products / Suggestions.

In any section previously mentioned, some identifying data will be asked for and will be used to process doubts, claims or suggestions made through the respective sections. These data are necessary to contact with the users and deal correctly with each case.

C. Candidates Data.

There is an email in our website that allows the receipt of CVs. All those CVs that arrive to this email provided by Banak will become part of the candidate database. The purpose of this database is to manage the applications of candidates, as well as to organize and control the selection process for the provision of vacancies in the entity. Personal data will be just transferred or communicated to third parties directly related with Banak, such as partners or member companies of Banak, for the same aforementioned purposes. This personal data won’t be transferred out of these cases, except in assumptions determined by the Law.

Additionally, you accept the maintenance of your data during a maximum period of 12 months in order to be kept in mind in those selection processes carried out by the Company or third parties directly related with it. After the expiry of that period, if no updates have been received, we will proceed to the destruction of these data.

D. Open your franchise Banak.

When filling the form belonging to this section, the data provided will be used to contact you and to start the paperwork in order to reach an agreement of franchise.

E. General terms for the processing of the information through the website of Banak.

1. Banak understands that the data has been entered by its owner or by an authorized person and that they are correct and accurate.

2. In accordance with the legislation in force on data protection, Banak has adopted the appropriated security levels for the data provided by users and, in addition, has used all the means and measures available to prevent the loss, use, alteration, unauthorized access and extraction thereof.

By checking the consent box you are accepting the treatment of your personal data for the aforementioned purposes. Likewise, you will be able and at all times to revoke this consent for the use of your personal data with promotional purposes by sending an email to the aforementioned email address.

Second: with the legitimate interest of getting to know you better and providing you the best service, of knowing better your interests and increasing the satisfaction degree with our brand. Third: because they are necessary for the development of the contractual relation in case of purchasing products, for example, - without them we cannot carry out the delivery.

5. To which third parties will the data be communicated?

Personal data won’t be communicated to third parties external to Banak, except for two reasons:

a. In case you finance a purchase, identification data will be provided to the Financial Entity for approval.

b. In order to value your CV for a job in some of the entities related with Banak, such as collaborators or companies linked by identical purposes, as aforementioned. However, remember that you are always able to oppose such uses by indicating it in the email personas@banak.com

6. What are your rights when you provide us your data?.

Anybody can know if Banak is processing personal data that concern them or not. However, the persons concerned have right to ask for the rectification of the incorrect data or to ask for the cancellation when, among other reasons, the data are not necessary anymore for the initial purposes.

You can request, when the reasons coincide, the limitation of the treatment of your data; in this case Banak will preserve this data for the exercise or defence of claims. Finally, you will be able to request, if it is technically possible, your right of portability of your data to a third part designated by you.
